With sentence no. 194 of November 9, 2018, the Italian Constitutional Court declared constitutionally illegitimate article 3, paragraph 1, of Legislative Decree no. 23/2015 (the so-called Job’s Act), both in the original text and in the text recently amended by Legislative Decree no. 87 of July 12, 18, converted into Law no. 96 of August 9, 18 (the so-called Dignity Decree). The judgment of unconstitutionality mainly affects the criteria that the law identifies and indicates for the quantification of the indemnity provided for the hypothesis of illegitimate dismissal.
